1. Acceptance of Terms

By accessing or using Phantom Messages Forwarder ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

These terms constitute a legally binding agreement between you and Phantom Messages Forwarder. We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms.

2. Service Description

Phantom Messages Forwarder is a web-based Software-as-a-Service (SaaS) platform that automates Telegram message forwarding. The Service includes:

• Automated message forwarding between Telegram chats
• Advanced filtering capabilities (keywords, media types, users)
• Ghost Mode for invisible forwarding via bot
• Message transformation tools (find/replace, formatting, captions)
• History import functionality
• AI-powered features (translation, summarization, content filtering)
• Analytics and reporting dashboard

Service availability is subject to plan limitations. Features and capabilities vary by subscription tier (Lite, Smart, Gold, Platinum).

3. Account Registration

To use the Service, you must:

• Provide a valid Telegram phone number
• Complete the verification process via Telegram authentication code
• Be at least 18 years old or have parental consent
• Maintain accurate and current account information
• Protect your account credentials and not share them with third parties

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breaches.

4. Subscription Plans and Payments

Trial Period: New users receive a 7-day free trial with full Platinum features. No credit card required for trial activation.

Paid Plans: After trial expiration, you may subscribe to:

• Lite: $8/month - Limited features, admin-only chats
• Smart: $8/month - Real-time forwarding, 5 rules
• Gold: $11/month - Ghost Mode, 25 rules, advanced features
• Platinum: $14/month - Unlimited rules, AI features, API access

Billing Cycles: Choose monthly, quarterly (-20%), or yearly (-40%) billing. Subscriptions auto-renew unless cancelled.

Payment Processing: Payments are processed securely via Stripe. We do not store credit card information. By subscribing, you authorize us to charge your payment method for the selected plan.

5. Acceptable Use Policy

You agree NOT to use the Service to:

• Spam, harass, or send unsolicited messages to Telegram users
• Forward copyrighted content without authorization
• Distribute malware, phishing links, or malicious content
• Violate Telegram's Terms of Service or any applicable laws
• Engage in illegal activities, fraud, or scams
• Scrape, harvest, or collect user data without consent
• Bypass rate limits or abuse API quotas
• Resell or redistribute the Service without permission

Violation of this policy may result in immediate account suspension or termination without refund.

6. Service Limitations and Availability

We strive to provide 99.9% uptime but cannot guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (announced in advance)
• Emergency repairs or security updates
• Third-party service disruptions (Telegram API, hosting providers)
• Force majeure events beyond our control

We are not liable for any losses resulting from service interruptions. Rate limits and quotas apply per plan tier.

7. Data and Privacy

Your use of the Service is governed by our Privacy Policy. Key points:

• Telegram sessions are encrypted and stored securely
• We do not read or store your private messages
• Forwarding rules and logs are retained for operational purposes
• We comply with GDPR and data protection regulations

You retain ownership of all content you forward. We claim no rights to your data.

8. Intellectual Property

The Service, including its codebase, design, trademarks, and documentation, is owned by Phantom Messages Forwarder and protected by copyright laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or business purposes. You may not reverse engineer, decompile, or create derivative works from the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOM MESSAGES FORWARDER SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from unauthorized access to your account
• Third-party actions (Telegram bans, API restrictions)

Our total liability for any claim is limited to the amount you paid in the 12 months prior to the claim.

10. Account Termination

You may terminate: Cancel your subscription at any time via the dashboard. Access continues until the end of the current billing period. No refunds for partial months.

We may terminate: We reserve the right to suspend or terminate accounts that violate these terms, engage in abusive behavior, or pose security risks. Termination may be immediate without prior notice.

Upon termination, your data is retained for 30 days for potential reactivation, then permanently deleted.

11. Dispute Resolution

Any disputes arising from these terms shall be resolved through:

1. Good faith negotiation between parties
2. Mediation if negotiation fails
3. Binding arbitration as a last resort

These terms are governed by the laws of Italy. You agree to submit to the exclusive jurisdiction of Italian courts.

12. Changes to Terms

We may update these Terms of Service at any time. Material changes will be communicated via:

• Email notification to your account
• In-app notification banner
• Updated "Last modified" date at the top of this page

Continued use of the Service after changes constitutes acceptance. If you disagree with modifications, you must stop using the Service.
